Agreeing to these terms
These terms are an agreement between you and YaghyDev (“we”, “us”), who make and run Franchise Empire. They apply to the Franchise Empire app, its servers and this website. By creating an account or playing, you agree to them and to our privacy policy. If you don’t agree, please don’t use the game.
Nothing in these terms takes away rights you have as a consumer under the laws of the country you live in. Where a term here conflicts with such a law, the law wins and the rest still applies.
Your account
- You sign in with Apple or Google. You need to be old enough to agree to these terms where you live, or have a parent or guardian agree for you.
- One person, one account. Keep your Apple or Google account secure: whatever is done with your account is your responsibility.
- Your username must be 3–16 letters, digits or underscores with at least one letter, and unique. Usernames, company names and brand names must not be offensive, hateful, sexual, misleading, or impersonate someone else; we may change or remove ones that are.
- Accounts are personal: you may not sell, trade, lend or transfer them.
Your licence to play
We give you a personal, limited, non-exclusive, non-transferable and revocable licence to install and play Franchise Empire on devices you own or control, for your own non-commercial entertainment. You may not copy, modify, decompile, reverse engineer, resell or redistribute the game, except as the law expressly allows.
Gems, cosmetics and other virtual items
The game has in-game money (the cash your company earns), gems (a premium currency), cosmetics (restaurant themes, signs, headquarters styles and decorations) and other virtual items.
- Virtual items are a licence to use them in the game, not property you own. They have no value outside the game, can’t be exchanged for real money or anything else, and can’t be transferred to another account.
- Gems can be bought, and are also earned by playing (milestones and optional rewarded ads). They are spent on speed-ups, time skips, cosmetics and a longer offline limit.
- Your gem balance is the one our server holds. If a mistake or a bug credits or takes gems or items that shouldn’t have been, we may correct it, and we’ll make it right if the mistake was ours.
- We may rebalance prices, rewards, items and the game’s economy over time to keep it fun and fair.
Purchases and refunds
- Purchases are made through Apple’s App Store or Google Play, under their terms and at the price shown in the store. They are one-time purchases; there are no subscriptions.
- Once delivered to your account, gems and items are yours to use and purchases are final, except where the law or the store’s policy gives you a right to a refund.
- Refunds are handled by the store: reportaproblem.apple.com for the App Store, or Google Play’s order history. If a purchase is refunded, we may remove what it gave you from your account.
- If you paid and didn’t receive what you bought, write to us and we will sort it out.
Rewarded ads
Rewarded ads are optional: you choose to watch one in exchange for the reward the game shows. Rewards have daily limits, and a reward is only given once an ad has been watched (or, with the Ad Pass, once you claim it). Ads are provided by Google AdMob; we don’t control their content, but you can report an inappropriate ad to us.
Fair play
Franchise Empire is meant to be fair for everyone on the leaderboards. You agree not to:
- cheat, hack, or use modified apps, emulated purchases, bots, scripts, or tools that automate play or change the game;
- tamper with saves, the clock, network traffic or our servers, or try to get around limits on ads, purchases or offline earnings;
- exploit bugs instead of reporting them;
- harass anyone, or use the game for anything unlawful.
Our server checks every save. Saves that break the game’s rules may be rejected or rolled back, and implausible ones are hidden from the leaderboards while we look at them. If you break these rules we may reset progress, remove items, hide you from the leaderboards, or suspend or close your account.
Names you choose
You keep the rights to the names you choose for yourself and your company, and you allow us to display them in the game and on its leaderboards for as long as your account exists.
Changes and availability
We work hard to keep the game running, but it needs an internet connection to sign in and save, and it may sometimes be unavailable for maintenance, updates or reasons outside our control. We may change, add or remove features. If we ever decide to shut the game down, we will tell players in the game at least 30 days before, and stop selling gems when we do.
Ending your account
You can stop playing at any time, and delete your account in the app (Settings → Account → Delete account) or by writing to us: here’s how. Deleting it removes your progress, gems and items for good. We may suspend or close an account that seriously or repeatedly breaks these terms; where it is fair to, we’ll tell you why first.
Our game, our content
Franchise Empire, its name, logo, art, code, music and everything else in it belong to YaghyDev or our licensors. Restaurant chains, cities and companies in the game are fictional or used only for setting; any resemblance of a rival chain to a real business is a coincidence.
Disclaimers
The game is provided “as is” and “as available”. To the extent the law allows, we make no promises that it will be uninterrupted or free of errors, or that your progress can never be lost. This doesn’t affect any rights you have by law that can’t be excluded.
Franchise Empire is a game. Nothing in it is business, financial or legal advice.
Limitation of liability
To the extent the law allows, we are not liable for indirect or consequential losses, or for loss of virtual items, and our total liability to you is limited to what you paid us in the 12 months before the claim. We don’t limit liability where the law doesn’t allow it, such as for death or personal injury caused by negligence, or for fraud.
Law and disputes
If something goes wrong, please write to us first: most problems are solved quickly that way. These terms are governed by the laws of the place where YaghyDev is established, but if you are a consumer you also keep the protection of the mandatory laws of the country you live in, and can bring a claim in its courts.
Apple and Google
These terms are between you and us, not Apple or Google, and we, not they, are responsible for the game and for support. If you downloaded the game from the App Store, Apple’s Licensed Application End User License Agreement also applies; Apple has no obligation to provide maintenance or support for the game; Apple is not responsible for claims about it (including product liability, legal compliance or intellectual property claims); and Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. If the game fails to conform to any warranty that applies, you may notify Apple, which may refund the purchase price of the app (if any); Apple has no other warranty obligation to you. You confirm you are not in a country under a U.S. Government embargo, and not on a U.S. Government list of prohibited or restricted parties.
Changes to these terms
We may update these terms as the game changes. We will change the date at the top, and tell you in the game before significant changes take effect. Continuing to play after that means you accept the new terms.
